TERMS AND CONDITIONS

1. Session Usage Timeframe

All purchased sessions must be used within the agreed timeframe.

DM Personal Training expects each block of sessions to be completed within one calendar month from the start date.

The number of sessions per week will depend on the block purchased:

  • Block of 4 – typically 1 session per week

  • Block of 8 – typically 2 sessions per week

  • Block of 12 – typically 3 sessions per week

  • Block of 16 – typically 4 sessions per week

 

Verbal agreements on the specific timetable are acceptable, but all sessions remain subject to these Terms and Conditions.

Any sessions not used within the agreed period will be forfeited unless an extension is granted at the trainer’s discretion.

 

2. Cancellations and No-Shows

A minimum of 24 hours’ notice is required to cancel or reschedule a session.

If less notice is given, the session will be counted as used and cannot be refunded or rescheduled.

Genuine emergencies will be considered—please contact Dean directly.

 

If cancellations become repeated or excessive, DM Personal Training reserves the right to treat any remaining sessions in the block as forfeited, even if notice has been given, in order to maintain the agreed timeframe and training schedule.

 

3. Refunds

All packages are non-refundable.

Once payment has been made, the client is committed to the agreed number of sessions and hours within the set timeframe.

The full block of sessions must be completed as agreed.

In exceptional circumstances (for example, serious illness or injury), sessions may be postponed at the trainer’s discretion but will not be refunded.

 

4. Health and Responsibility

Clients are responsible for informing the trainer of any changes to their physical or mental health that may affect training.

All training is undertaken at the client’s own risk.

A PAR-Q (Physical Activity Readiness Questionnaire) will be required before starting.

 

5. Trainer Commitment

The trainer agrees to provide professional, personalised training sessions and to offer reasonable flexibility and support to help clients achieve their goals.

 

6. Client Commitment

By agreeing to these terms, clients commit to attending sessions regularly, communicating clearly, and giving their best effort during training.

Consistent attendance and engagement lead to the best results.

HEALTH DISCLAIMER

Because physical exercise can be strenuous and subject to risk of serious injury, your personal trainer urges you to obtain a physical examination from a doctor before beginning any exercise or training program. You agree that by participating in these physical exercise sessions or personal training activities, you do so entirely at your own risk. 
 

This includes, without limitation, (a) your use of all amenities and equipment in the facility and any off site location and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction, training, supervision, or dietary recommendations. 
 

You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury. You expressly agree to release and discharge your personal trainer or instructor, and from any and all claims or causes of action. This waiver and release of liability includes, without limitation, all injuries to you which may occur, regardless of negligence. 

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. 

  

You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability. You agree to voluntarily give up any right that you may otherwise have to bring a legal action against the personal trainer or instructor for negligence, or any other personal injury or property damage or loss action.
